Construction projects in the modern age of law face a myriad of interrelated and sometimes conflicting rules and obligations. Construction projects require (i) planning and permitting to assuring compliance with covenants, land use regulations and building codes, (ii) financing, which embodies a range of issues related to construction financing, (iii) negotiating and finalizing contracts among property owners, architects, engineers, contractors, subcontractors and financial institutions, and (iv) proper controls to assure that projects are completed in a timely and workmanlike manner. When projects go awry, in addition to the usual breach of contract claims, disputes implicate the parties’ rights and obligations under Colorado’s Mechanic’s Lien Statute, Trust Fund Statute or the Construction Defect Action Reform Act.
